Stressing the importance of addressing all issues within the framework of the law,
The Coalition for Integrity and Accountability (AMAN) Calls for Strengthening Guarantees of Law Enforcement in Corruption Cases to Prevent Impunity
Ramallah – The Coalition for Integrity and Accountability (AMAN) sent an official letter to His Excellency Prime Minister Dr. Mohammad Mustafa, calling for the strengthening of guarantees of law enforcement in handling cases and for ensuring that no settlements are reached outside the judicial process, so as to prevent impunity in corruption cases. This comes as part of its serious follow-up on the ongoing investigations into major and vital corruption files that affect public funds and involve employees and officials who hold senior positions or public influence, in addition to company owners from the private sector.
The Coalition explained in its letter that Palestinian society views these developments as a genuine test of the rule of law and of the principle of equality before the judiciary, which requires the realization of prompt justice through the completion of the judicial process in accordance with proper procedures. This begins with a professional and safeguarded investigation, followed by sound legal referrals and a fair trial, and culminates in enforceable judgments and effective measures to recover public funds and pursue illicit proceeds.
The Coalition for Integrity and Accountability (AMAN) stressed the importance of addressing all cases within the framework of the law, calling for the strengthening of oversight and measures to prevent any settlements outside the legal framework or the proper course of litigation procedures, while demanding guarantees of fair investigation and judgment for all defendants, and ensuring that such processes remain fully subject to the oversight of the relevant Public Prosecution and judiciary.
Proceeding from the constitutional and institutional responsibility of the government to safeguard the rule of law and ensure its enforcement, the Coalition for Integrity and Accountability (AMAN) called upon the Prime Minister, in a letter copied to the Head of the Anti-Corruption Commission, Dr. Raed Radwan, to work toward strengthening guarantees for the enforcement of the law. This should be achieved through explicit and clear affirmation that corruption cases, particularly those related to public funds, must follow the judicial process and must not be managed, closed, or addressed through any parallel arrangements outside the jurisdiction of the Public Prosecution and the relevant judiciary, in accordance with the provisions of Article (25) of the Anti-Corruption Law No. (1) of 2005. The Coalition further warned that resorting to settlements or allowing gaps in law enforcement constitutes a clear violation of the law and fundamentally undermines the principle of the rule of law, erodes the principle of equality before the judiciary, and practically opens the door to impunity, thereby entrenching an environment that reproduces corruption and leads to the weakening of public confidence in official institutions.
