Aman Coalition's position on the issuance of financial and administrative regulations for public institutions by the Office of the President
Following the enactment by the President's office of the administrative regulations No. (1) of 2025 and the financial regulations No. (2) of 2025 for the Palestinian National Economic Empowerment Institution (PNEEI), both published in the Official Gazette No. (228) of July 2025, the Coalition for Integrity and Accountability (AMAN) reaffirms its principled position against the expansion of the authorities of the President beyond his constitutional mandate, especially in the absence of the legislative council. The President continues to issue secondary regulations, which fall under the mandate of the Council of Ministers, thereby breaching the Basic Law.
Article 69 of the amended Basic Law explicitly stipulates that the Council of Ministers is the competent authority for issuing the regulations and executive rules necessary for the implementation of laws. which renders the issuance of financial and administrative regulations by the Office of the President a clear constitutional violation, falling within the scope of the executive branch's encroachment on the powers of the government, thereby weakening the principle of separation of powers and undermining the foundations of good governance.
This breach is one of a series of breaches, including the President’s Law by Decree No. (23) of 2024, amending the State Administrative Audit and Control Bureau Law No. (15) of 2004, as amended. The new decree subjugated SAACB’s staff to an administrative regulation issued by the President, in clear violation of the Basic Law.
This recurring pattern of unconstitutional legislation not only bypassess the powers of the Council of Ministers, but also erodes the principle of the rule of law, weakens institutional reform efforts, and increases legal uncertainty in the management of public institutions, at a time when there is a growing need to strengthen citizens' trust in state institutions, especially in the absence of the Legislative Council.
